Terms of Use
By accessing and using the Challo Tech app, you agree to be bound by these terms and conditions. If you do not agree with any part of these terms, you may not use our services. These terms may be updated from time to time, and it is your responsibility to review them periodically.
Account Registration
To use certain features of our app, you must register for an account. You agree to provide accurate and complete information during registration and to keep your account credentials secure. You are responsible for all activities that occur under your account. You must notify us immediately of any unauthorized use or security breach.
Product Purchases
All product purchases are subject to availability. Prices are subject to change without notice. We reserve the right to refuse service to anyone for any reason at any time. When you make a purchase, you agree to pay the full amount charged to your selected payment method. All sales are final unless otherwise specified in our return policy.
Repair Services
Repair services are provided as-is. While we strive for excellence, we cannot guarantee that all repairs will resolve all issues. Warranty terms vary by product type and will be clearly expressed on the specific product page at the time of purchase. Service warranties for repairs will be communicated before service begins. We provide a standard 90-day warranty on all replaced parts unless otherwise specified. You agree to provide accurate information about your device and its issues. We are not responsible for data loss during repairs.
Shipping & Delivery
Delivery timeframes are estimates only and not guaranteed. Risk of loss and title for items purchased pass to you upon delivery to the shipping carrier. We are not responsible for delays due to customs, weather conditions, or other circumstances beyond our control.
Returns & Refunds
Products may be returned within 30 days of purchase if in original condition. Refunds will be issued to the original payment method. Custom or personalized items cannot be returned unless defective. Shipping costs for returns are the customer's responsibility unless the return is due to our error.
Privacy & Data
Your use of our app is also governed by our Privacy Policy. By using our app, you consent to our collection and use of data as outlined in the Privacy Policy. We implement reasonable security measures to protect your personal information, but no method of transmission is 100% secure.
Data Privacy and Analytics
We collect anonymous usage data through PostHog analytics to improve our services. All analytics data is collected with strict privacy protections in place: we anonymize IP addresses, disable geolocation tracking, exclude device identifiers, and aggregate usage data in a way that cannot be traced back to individuals. You can opt out of analytics data collection at any time through your app settings or by contacting us.
Intellectual Property
All content in the app, including but not limited to text, graphics, logos, and software, is the property of Challo Tech and is protected by copyright and other intellectual property laws. You may not reproduce, distribute, or create derivative works without our express permission.
User Conduct
You agree not to use the app for any unlawful purpose or in any way that could damage, disable, or impair our services. You also agree not to attempt to gain unauthorized access to our systems. We reserve the right to terminate your access if you violate these terms or engage in fraudulent or harmful activities.
Limitation of Liability
Challo Tech shall not be liable for any indirect, incidental, special, consequential, or punitive damages resulting from your use or inability to use the app or services. Our total liability for any claims arising from these terms shall not exceed the amount you paid for the product or service that is the subject of the claim.
Indemnification
You agree to indemnify and hold Challo Tech, its affiliates, officers, agents, and employees harmless from any claims, losses, liabilities, and expenses (including attorney's fees) arising from your use of the app or violation of these terms.
Door-to-Door Pickup Service
For our door-to-door device pickup and delivery service, you agree to be present at the scheduled time and location. We are not responsible for devices that are not handed directly to our authorized representatives. Our representatives will carry proper identification which you should verify before handing over your device. Pickup schedules are subject to availability and may be affected by factors beyond our control.
Content Sharing and User Engagement
Our platform provides access to technology news and information sourced from third-party providers. These articles, images, and other content are owned by their respective publishers and creators, not by Challo Tech. While our app allows you to engage with this content through likes, bookmarks, and sharing, you agree to respect the original ownership and copyright of the content. When sharing such content, you should maintain all attribution and comply with the content owners' terms of use. Challo Tech is not responsible for the accuracy, availability, or content of third-party information. We reserve the right to remove any content or restrict access to content that violates intellectual property rights or applicable laws.
Data Storage and Repair History
We maintain records of your repair history to provide better service. This data is stored securely and in accordance with our Privacy Policy. You can access your repair history through your account. We retain this information for as long as you maintain an account with us or as required by applicable laws.
Governing Law
These terms shall be governed by and construed in accordance with the laws of Kenya, without regard to its conflict of law provisions. Any disputes arising from these terms shall be resolved exclusively in the courts of Kenya.
Changes to Terms
We reserve the right to modify these terms at any time. We will notify users of any material changes via the app or email. Continued use of the app after changes constitutes acceptance of the new terms. It is your responsibility to review these terms periodically for changes.
